Update on Proposed ADA Amendments Act Regulations
On September 23, 2009, the Equal Employment Opportunity Commission issued the new proposed Americans with Disabilities Act regulations. These are the proposed regulations we have been waiting for to provide guidance for implementing the changes to the equal employment provisions of the Americans with Disabilities Act made by the ADA Amendments Act of 2008.
There will be a 60 day public comment period, which goes through November 23, 2009. Some employment law experts believe that the EEOC intends to apply these regulations retroactively once they are finalized, making it dangerous not to comply with them now--if not to the letter, then at least in spirit. As a result, it is essential for employers to quickly get up to speed on the EEOC proposals. The New Family Medical Leave Act Regulations Including the Military Service Leave Regulations
Effective January 16, 2009, the Department of Labor significantly revised the FMLA regulations. They overhauled the original regulations governing the FMLA, plus they spelled out exactly what's required in implementing the new Military Family Leave Amendments. You will want to be up-to-date on these changes before it is time to revise your local policies. TASB Policy Service released Update 85 on May 5, 2009 with revisions to DEC (LEGAL) and recently published the "Leaves and Absences" Starting Points for revisions to DEC (LOCAL) to assist you in incorporating the changes to the regulations into your local policies.
