On September 23, 2009, the Equal Employment Opportunity Commission issued the new proposed Americans with Disabilities Act regulations. These are the proposed regulations we have been waiting for to provide guidance for implementing the changes to the equal employment provisions of the Americans with Disabilities Act made by the ADA Amendments Act of 2008.

There will be a 60 day public comment period, which goes through November 23, 2009. Some employment law experts believe that the EEOC intends to apply these regulations retroactively once they are finalized, making it dangerous not to comply with them now--if not to the letter, then at least in spirit. As a result, it is essential for employers to quickly get up to speed on the EEOC proposals.
