Letter to Retain Eminent Domain Authority
Details
The Texas Legislature extensively amended Texas’s eminent domain statutes in 2011. Independent school districts and other government entities will lose the power of eminent domain as of September 1, 2013, unless they take action to reassert this power before December 31, 2012. To retain your eminent domain powers, you must fill out and file with the state comptroller a statement of intent to retain your eminent domain authority.

Resolution Authorizing the Taxation of Goods-in-Transit
Details
Section 11.253 of the Texas Tax Code, which allows local governments to tax otherwise exempt personal property referred to as “goods-in-transit” has been amended. All school districts that wish to impose ad valorem taxes on goods-in-transit after 2011, including those districts that currently impose such tax, must meet the requirements of amended Section 11.253. This is our model resolution that should be adopted by your board of trustees.
